Interplay wants their money back

Post by King of Creation »

[ Company -> Update ] - More info on Company: Bethesda v. Interplay

The Inteplay v. Bethesda saga continues!

After prevailing at the preliminary injunction hearing, Interplay now wants its legal fees paid for by Bethesda. In the latest court filings from the California games company, Interplay cites some legal stuff and says that it deserves to have the legal fees paid for. Here's the skinny from Interplay's most recent filing:

Pursuant to Federal Rules of Civil Procedure, Rule 54 and Rule 109.2 of the Local Rules of the United States Disctrict Court for the District of Maryland, Defendant/Counter-Claimant Interplay Entertainment Corp. ("Interplay"), hereby moves the Court for an award of the attorney fees and expenses that it incurred in successfully defending against the Motion for Preliminary Injunctions (the "Motion") filed against it by Plaintiff/Counter-Defendant Bethesda Softworks, LLC, ("Bethesda").

Interplay's total legal fees and expenses recoverable expenses for the trial? $9,539.38.

A breakdown:

Travel Expenses for Herve Caen and the 2 lawyers: $3,901.32

Deposition of James Leder, COO of Bethesda: $3,525.00

Online Legal Research: $1,686.40

Overnight mail to Court and Opposition Counsel: $225.76

Postage: $2.40

Photocopy Charges: $197.50

Interplay also notes that they will file some more expense details in the coming days, so stay tuned!

Update: Upon looking into the filing further, Interplay notes that their actual legal fees are in excess of $100,000.

Interplay estimates that its legal fees will exceed $100,000, and its recoverable costs and expenses are $9,539.38.

That seems a bit jumping the gun, since they haven't won the entire case. It's like arguing all those costs were incurred solely in defending against a preliminary injunction case, rather than the case as a whole. That seems unlikely.

Herve must be desperate for cash. Shit I could pay that fee fairly easily.

Yeah, I was a bit surprised at the costs for everything. I would have expected a much higher price tag for everything, considering the companies involved. I'll bet Bethesda's legal fees were a lot higher though.
